# Misty terms of service

Simple terms for using Misty: your account, AI agent actions, subscriptions and limits on our responsibility.

## 1. Using Misty

Misty is provided by Matagi OÜ (registration number 17221751), Valukoja 10, 11415 Tallinn, Estonia. These terms apply to getmisty.ai and the Misty service. Questions? Contact hello@matagi.ai.

By creating an account or using Misty, you agree to these terms. You must be at least 18 and able to enter a contract. If you use Misty for a business, you must have permission to act for it. Keep your account secure and your information accurate.

## 2. Your AI agent, your oversight

Misty uses AI to research brands, prepare content and help manage outreach and conversations. AI can misunderstand instructions, invent facts, choose unsuitable recipients or take incorrect actions. Check important information, rates, recipients and commitments before relying on them.

You choose the instructions, permissions and automation settings for your account. When you enable Auto mode, you authorize the actions described by that feature within your settings, including messages without individual review where enabled. Monitor activity and pause or change settings when needed. An action already completed may not be reversible.

You are responsible for the content and instructions you supply, the actions you approve or authorize, and the deals you agree with brands. Misty does not guarantee accurate outputs, replies, work, income or any particular result. You decide whether to accept an offer and sign a contract; Misty is not a substitute for legal, financial or other professional advice.

## 3. Use Misty responsibly

Use only content, accounts and contact information you are entitled to use. Follow applicable privacy, marketing and anti-spam rules and the rules of connected platforms. Do not use Misty for fraud, harassment, unlawful impersonation, unauthorized access or other illegal activity, or to bypass safety and usage limits.

## 4. Your content and privacy

You keep your rights in content you provide. You give us permission to store, process and share it with the service providers needed to run Misty and carry out your instructions. Content you choose to publish, such as a portfolio, is public. Our Privacy & cookies notice explains how we handle personal information and cookie choices.

## 5. Subscriptions and cancellation

Your checkout shows the price, billing period, applicable taxes and included usage. A subscription renews until you cancel. Cancel through your billing settings before the next renewal to stop future charges; access normally continues until the end of the paid period. Unused time or usage is not refunded unless required by law or expressly offered by us. Any mandatory cancellation, withdrawal and refund rights still apply.

## 6. Limits on our responsibility

To the extent permitted by law, Misty is provided as available, without promises that it will always be accurate, uninterrupted or error-free. We do not guarantee third-party services, brand conduct, payment by brands or the outcome of any negotiation.

To the fullest extent permitted by law, Matagi OÜ is not liable for losses arising from AI-generated content or agent actions you authorize, including automated messages, mistakes, omissions or reliance on an output. We exclude liability for indirect or consequential loss and loss of profits, revenue, opportunities, goodwill or data.

Where liability cannot be excluded but can lawfully be limited, our total liability for claims relating to Misty is limited to the greater of €100 or the fees you paid for Misty in the 12 months before the event giving rise to the claim.

These limits do not apply to fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot legally be excluded or limited. Nothing here removes your mandatory consumer rights or our obligations under applicable data protection law.

## 7. Ending use and changes

You can stop using Misty and cancel your subscription at any time. We may restrict or suspend access for misuse, non-payment or a security risk. If we permanently end a paid service for reasons unrelated to your breach, we will refund the unused prepaid period.

We may update these terms as Misty changes. We will give advance notice in the service of material changes, including when they take effect. You can stop using Misty and cancel before they apply. Changes do not apply retroactively to an existing dispute.

## 8. Questions and disputes

Please contact hello@matagi.ai first so we can try to resolve a problem. Estonian law governs these terms and disputes may be brought in the Estonian courts. If you are a consumer, any mandatory protections and rights to use courts in your country of residence remain available. If one provision is unenforceable, the remaining terms still apply.
